These Terms of Service and End User License Agreement (the "Terms") govern your use of the ProgressShot iOS application (the "App") provided by CodingValue ("we," "our," or "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
This App is a Licensed Applicationunder Apple's standard End User License Agreement (EULA). These Terms incorporate the minimum terms required by Apple and apply in addition to them. Where these Terms conflict with Apple's requirements, Apple's requirements prevail.
1. Acknowledgment
These Terms are concluded between you and CodingValue only, and not with Apple. CodingValue, not Apple, is solely responsible for the App and its content. Apple has no obligation to furnish any maintenance or support services with respect to the App.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes on any Apple-branded device that you own or control, as permitted by the App Store Usage Rules in the Apple Media Services Terms and Conditions. You may not copy, modify, reverse-engineer, decompile, distribute, sell, lease, or sublicense the App except as expressly permitted by law.
3. Your Content
The App lets you import, edit, combine, and export your own photos ("Your Content"). You retain all rights to Your Content. All processing happens locally on your device; we do not access, upload, or store Your Content on our servers. You are solely responsible for Your Content and for ensuring you have the rights to use any images you import.
4. Acceptable Use
You agree not to use the App to:
- Violate any applicable law or regulation
- Create or share content that is unlawful, infringing, defamatory, or that violates another person's privacy or rights
- Reverse-engineer, interfere with, or attempt to gain unauthorized access to the App or its related systems
- Use the App in any way that could disable, overburden, or impair it
5. Subscriptions & Auto-Renewal
- Premium subscription: The App offers optional auto-renewable subscriptions that unlock premium features. Pricing is shown in the App before purchase and may vary by region.
- Billing: Payment is charged to your Apple ID account at confirmation of purchase.
- Auto-renewal: The subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
- Managing & cancelling: You can manage or cancel your subscription, and turn off auto-renewal, in your Apple ID Account Settings after purchase. Cancellation takes effect at the end of the current billing period.
- Free trial (if offered): Any unused portion of a free trial is forfeited when you purchase a subscription, where applicable.
- Refunds:Purchases are handled by Apple. Refund requests are subject to Apple's policies; we cannot directly issue refunds for App Store purchases.
6. Advertising
The free version of the App displays advertisements served by Google AdMob. A premium subscription may remove or reduce ads as described in the App.
7. Maintenance and Support
CodingValue is solely responsible for providing any maintenance and support for the App, as required by law. Apple has no obligation to provide maintenance or support for the App. For support, contact us using the details below.
8. Warranty
The App is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by applicable law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for the App. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are CodingValue's responsibility.
9. Product Claims
CodingValue, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including but not limited to: (i) product liability claims; (ii) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.
10. Intellectual Property
In the event of any third-party claim that the App or your possession and use of the App infringes that third party's intellectual property rights, CodingValue, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim. The App and its original content (excluding Your Content) are owned by CodingValue and protected by applicable intellectual property laws.
11. Legal Compliance
You represent and warrant that (i) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist-supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.
12. Third-Party Beneficiary
You acknowledge and agree that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
13. Third-Party Services
The App relies on third-party services (Google AdMob, Google Firebase, RevenueCat, Google ML Kit, and the Apple App Store). Your use of those services is governed by their respective terms. We are not responsible for third-party services.
14. Disclaimer & Limitation of Liability
To the maximum extent permitted by law, CodingValue shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claim arising out of these Terms or the App shall not exceed the amount you paid us (if any) for the App in the twelve months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless CodingValue from any claims, damages, or expenses arising out of your misuse of the App, your violation of these Terms, or your violation of any rights of a third party.
16. Termination
These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of them. Upon termination, you must stop using the App and delete all copies.
17. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles, except where Apple's Media Services Terms and Conditions or your local mandatory consumer-protection laws require otherwise.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of any changes by posting the updated Terms on this page and updating the "Last Updated" date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
